This is an appeal from a conviction for murder. Trial was before a jury, and the court assessed punishment at life. The Fourth Court of Appeals (San Antonio) affirmed, holding, inter alia, that the States sole eye witness, an eleven-year-old great-granddaughter of the murder victim, was not an "accomplice witness" as a matter of law or fact, as she could not have been prosecuted because of her age, and that appellant had no reasonable expectation of privacy in the premises searched or the evidence seized. Villarreal v. State, 685 S.W.2d 449 (Tex.App.--San Antonio, 1985). We granted appellants Petition for Discretionary Review to examine these holdings.
